Rape charges against New Mexico RB Crusoe Gongbay dropped

New Mexico RB Crusoe Gongbay is now no longer facing rape charges for an April incident.


The charges against Gongbay and another New Mexico student were dropped on Monday as the Bernadillo County district attorney's office cited a lack of evidence in the case. However, the case has not been dropped entirely and the charges could be refiled pending further investigation.


According to KRQE.com, charges against DB SaQwan Edwards, who was arrested after Gongbay and the other man, will be dropped later this week. When Gongbay and the other man, Ryan Ruff, were initially charged, authorities were looking for a third suspect.


In April, a female UNM student accused the three of raping her at gunpoint. After the incident was reported, Gongbay turned himself in. The woman initially said that the three alternated sexually assaulting her in the back of a BMW.


Gongbay's attorney Robert Cooper told KRQE that “The story that was given by the individual was not truthful. It’s that simple.”


George Anthony Bleus, an attorney for the other student, Ryan Ruff, says there's a tape that will show Ruff did nothing wrong.


Both Edwards and Gongbay were suspended from the team after the charges were filed. According to a team spokesperson, any change in suspension status would come from coach Bob Davie and New Mexico's athletic director.


Gongbay had 591 yards rushing as a junior in 2013 while Edwards had 42 tackles, three fumble recoveries and an interception.
